§ 1 Information on the collection of personal data

(1) In the following we will inform you about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, email addresses, user behaviour.

(2) The controller in accordance with Art. 4 (7) of the EU General Data Protection Regulation (GDPR) is SERCOO Group GmbH, Friedrich-Ebert-Strasse 125, 49811 Lingen, info@sercoo-group.de (see our legal notice). Our data protection officer can be reached at [datenschutz[at]sercoo-group[dot]de] or our postal address with the addition of “the data protection officer”.

(3) When you contact us by email or via a contact form, the data you provide (your email address, name and telephone number, if applicable) will be stored by us in order to answer your questions. We erase the data obtained in this context once storage is no longer required or restrict the processing if there are statutory retention obligations.

(4) If we use commissioned service providers for individual functions of our website or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. In doing so, we also state the defined criteria for the storage period.

§ 2 Your rights

(1) You have the following rights in relation to personal data relating to you:

  • Right of access,
  • Right to rectification or erasure,
  • Right to restriction of processing,
  • Right to object to processing,
  • Right to data portability.

(2) You also have the right to complain to the competent data protection supervisory authority in Lower Saxony about the processing of your personal data by us (The State Commissioner for Data Protection in Lower Saxony - Denis Lehmkemper, Prinzenstrasse 5, 30159 Hanover, poststelle@lfd.niedersachsen.de).

§ 3 Collection of personal data when visiting our website

(1) In the case of mere informational use of the website, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (legal basis is Art. 6 (1) (1) (f) GDPR):

  • IP address
  • Date and time of the enquiry
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Data volume transferred in each case
  • Website from which the request originates
  • Browser
  • Operating system and its interface
  • Browser software language and version.

(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive in relation to the browser you are using and which provide the body setting the cookie (in this case, us) with certain information. Cookies cannot run programs or transmit viruses to your computer. They are there to make the website as a whole more user-friendly and effective.

(3) Use of cookies:

a) This website uses the following types of cookies, the scope and functions of which are explained below:

  • Transient cookies (b)
  • Persistent cookies (c).

b) Transient cookies are automatically erased when you close the browser. These include in particular the session cookies. These store a so-called session ID, with which various enquiries from your browser can be assigned to the joint session. This allows your computer to be recognised when you return to our website. The session cookies are erased when you log off or close the browser.

c) Persistent cookies are automatically erased after a predefined period of time, which may differ depending on the cookie. You can erase the cookies in the security settings of your browser at any time.

d) You can configure your browser settings according to your preferences and, for example, refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all the functions of this website.

e) The Flash cookies used are not collected by your browser, but by your Flash plug-in. Furthermore, we use HTML5 storage objects that are stored on your end device. These objects store the required data regardless of the browser you are using and have no automatic expiry date. If you do not want Flash cookies to be processed, you must install an appropriate add-on, e.g. “Better Privacy” for Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) or the Adobe Flash Killer Cookie for Google Chrome. You can prevent the use of HTML5 storage objects by setting your browser to private mode. We also recommend that you regularly delete your cookies and browser history manually.

§ 4 Privacy policy for the contact form

The personal data that you provide to us as part of this contact request will only be used to respond to your request or to contact you and for the associated technical administration. The data will not be passed on to third parties.

You have the right to revoke your consent at any time with effect for the future. In this event, your personal data will be erased immediately.

Your personal data will also be erased without your revocation if we have processed your request or if you revoke the consent to storage granted here. This also happens if the storage is unauthorised for other legal reasons.

You can find out about the data stored about you at any time.

§ 5 Use of Google Analytics and the Google Tag Manager

(1) This website uses Google Analytics, a web analytics service provided by Google, Inc (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services relating to website activity and internet usage to the website operator.

(2) The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

(3) You may refuse the storage of cookies by selecting the appropriate settings on your browser; however, please note that if you do this, you may not be able to use all of this website’s functions. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: tools.google.com/dlpage/gaoptout.

(4) This website uses Google Analytics with the extension “_anonymizeIp()”. This means that IP addresses are processed in abbreviated form, which means that they cannot be traced back to a specific person. Insofar as the data collected about you has a personal reference, this is therefore immediately excluded and the personal data is thus erased straight away.

(5) We use Google Analytics to analyse and regularly improve the use of our website. The statistics obtained enable us to improve our website and make it more interesting for you as a user.

(7) This website also uses Google Analytics for a cross-device analysis of visitor flows, which is carried out via a user ID. You can deactivate the cross-device analysis of your usage in your client account under “Meine Daten” (My data), “persönliche Daten” (Personal data).

(8) Use of Google Tag Manager: Google Tag Manager is a solution that allows marketers to manage website tags through one interface. The Tag Manager tool itself (which implements the tags) is a domain without cookies and does not collect any personal data. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If anything has been deactivated at domain or cookie level, this remains in place for all tracking tags implemented with Google Tag Manager.

PRIVACY POLICY FOR DATA ON INTERESTED PARTIES, CLIENTS AND CONTRACTS

This data protection notice applies to the processing of personal data as part of pre-contractual measures (e.g. preparation of offers) and contract implementation (e.g. implementation of orders).

Who is responsible for data processing?

Further information about our company, details of those authorised to represent it and also further contact options can be found in our privacy policy and legal notice.

Which of your data do we process? And for what purposes?

For implementation of the contract we process the data provided by you: for the billing address: name, first name, address, telephone number, email address, if applicable different delivery address and, if you use the direct debit system, additionally your bank details (IBAN and name of the credit institution). If you do not provide us with the above-mentioned data, implementing the contract/delivery will not be possible.

What is the legal basis for this?

Data is processed for the sole purpose of fulfilling the contract. The legal basis for processing personal data is Art. 6 (1) (b) of the GDPR.

How long is the data stored?

The personal data will be stored for the duration of the contract and erased upon expiry of the statutory archiving obligations.

Who is the data disclosed to?

In principle, your data will not be disclosed to third parties, unless disclosure is necessary for the implementation of the contract and there is an authorisation to disclose under data protection law. We use other service providers for the processing of personal data, including for sending emails. All processors have been carefully selected, support us in accordance with instructions and are only given access to your data to the extent and for the period of time required to provide the services or to the extent that you have consented to the data processing and use.

Where is the data processed?

The data is processed exclusively on our own systems and in data centres in the Federal Republic of Germany / the European Economic Area.

Your rights as the “data subject”

You have the right of access to the personal data we process about you. In the case of a request for access that is not made in writing, we ask for your understanding that we may then require evidence from you to prove that you are the person you claim to be.

XING plugin

Our website uses functions of the XING network. The provider is XING AG, Dammtorstrasse 29-32, 20354 Hamburg, Germany. Each time one of our pages containing XING functions is accessed, a connection to XING servers is established. As far as we are aware, no personal data is stored when doing so. In particular, no IP addresses are stored or the usage behaviour analysed.
